Gestational Carrier & Surrogacy Legal Services in Illinois
Bringing a child into the world through gestational surrogacy is a life-changing journey—full of hope, complexity, and deeply personal decisions.
What is Gestational Surrogacy?
In a gestational surrogacy arrangement, the surrogate (also known as a gestational carrier) carries a child who is not genetically related to her. The embryo is created using the egg and sperm of the intended parents or donors, then transferred through IVF.
Illinois law recognizes gestational surrogacy as a legal pathway to parenthood—and offers clear legal protections when handled properly under the Illinois Gestational Surrogacy Act (GSA).
Legal Requirements Under Illinois Law
The Illinois GSA lays out specific requirements for gestational surrogacy contracts to be valid:
Intended Parents Must:
- Contribute at least one of the gametes (egg or sperm) to create the embryo.
- Have a medical need for surrogacy (e.g., infertility or medical risk to mother/child).
- Undergo legal and psychological consultation prior to entering the agreement.
- Be represented by independent legal counsel.
Gestational Carrier Must:
- Be at least 21 years old.
- Have previously given birth to at least one child.
- Complete medical and mental health evaluations.
- Be represented by separate legal counsel.
Intended Parents Must:
- Be in writing and executed before any medical procedures begin.
- Clearly outline the rights and obligations of all parties, including compensation, decision-making authority during pregnancy, intended parent responsibilities, and expectations around delivery.
- Comply fully with the Illinois GSA to allow for pre-birth parentage orders.
Why Legal Representation Matters
Even in a surrogacy-friendly state like Illinois, the legal, financial, and emotional stakes are high. A strong legal foundation protects:
• The parental rights of the intended parents,
• The bodily autonomy and safety of the gestational carrier,
• The well-being and future of the child.
We understand how personal and delicate these arrangements can be. Our goal is to provide straightforward legal protection while respecting the trust and intention that bring all parties together.
